A man in Atlanta who unintentionally fired a gun while fighting with another man on board a red line train was disarmed and beaten by the victim who held him until the Chicago police arrived, said officials.

Rufus Hunley IV, 30, got into a fight with a resident of Chicago, while around 9.30 pm on 27 April they were driving the train near Sox Park, according to a CPD report. At one point the victim felt threatened, so he hit Hunley in the face “out of self -defense,” the report said.

Hunley reacted by bringing out a gun, pointing out the Chicago man and warning that he “was about to find out,” say prosecutors. He started to hit the victim in the head with the firearm, so that it fired for a round on the Trainuto, according to the CPD report. Nobody struck the bullet.

Public prosecutors said the men fought for control over the firearm, with the victim rising as a victor. He repeatedly hit Hunkey when Hunley tried, but failed to regain control of the firearm. The victim gave the gun to the police on the spot.

Hunley told the police that he has a permit to bear firearms, but CPD has established that he is not permitted to wear weapons in Illinois, according to his arrest report.

Complaints asked Judge Mary Marubio to keep Hunley in prison awaiting the trial. She rejected their request and released him with orders to surrender any firearms to the police.

He is accused of illegal possession of a gun, worsened attack with a fatal weapon and battery.
